Deal Chief

Terms and Conditions

These Terms are a contract between you and MyCommunity Today, Inc., a Delaware corporation (“MyCommunity Today”, “we”, “us”), for the DealChief mobile apps, the dealchief.ai website and related services (“DealChief”). By creating an account or using DealChief, you agree to these Terms and to our Privacy Policy. If you use DealChief for a business or other organization, you agree on its behalf and confirm you have authority to do so; “you” then includes that organization. DealChief is also part of the MyCommunity Today platform at gomycommunity.com; when you use DealChief features there, the MyCommunity Today Terms and Conditions apply and contain the same rules.

PLEASE READ SECTION 20. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU CAN OPT OUT WITHIN 30 DAYS.

1. Eligibility and accounts

You must be at least 18 and able to form a binding contract. You may not use DealChief if you are barred under U.S. or other applicable law. Give accurate account information and keep it current. Keep your sign-in details secure, do not share your account, and tell us at support@dealchief.ai if you suspect unauthorized use. You are responsible for activity under your account.

2. What DealChief does

DealChief lets you chat, call and meet with other people; talk with AI agents that represent businesses; host and attend free or paid webinars; and earn referral rewards. We may add, change or remove features. Features labeled beta or preview may be unreliable and may change or end without notice. We will give reasonable notice before removing a feature you have paid for, and refund any prepaid, unused amount if we discontinue it.

3. AI agents and AI output

  • DealChief’s replies are generated by AI (“Output”) and can be wrong, incomplete or inappropriate. Check important details with the business directly, and do not rely on Output for legal, medical, financial or safety decisions.
  • As between you and us, you own the Output generated for you, and we assign to you any rights we have in it. Output may be similar to Output generated for others, and you do not gain rights in their Output.
  • Do not use Output to make decisions about a person’s credit, employment, housing, insurance or other significant matters.
  • If an AI reply is offensive or wrong, use the Report option on the message or email support@dealchief.ai.

If you run a business’s AI agent, you also agree to:

  • keep your business information accurate, and review what your agent says about your business;
  • honor or correct any price, offer or commitment your agent communicates, so set it up to say only what you are prepared to honor;
  • disclose that customers are talking to an AI where the law requires it, and not configure the agent to claim it is human;
  • not use the agent to collect payment card numbers, health information, government ID numbers or other sensitive information.

4. Your content

You keep ownership of what you provide, including messages, voice, video, uploads, business information, webinar materials and registration forms (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display and record Your Content only to operate, secure and improve DealChief, as described in the Privacy Policy and as your settings direct. This license ends when you delete Your Content or your account, except for copies others have lawfully kept (such as recordings a host saved or attendee lists a host exported) and backups held for a limited time.

You confirm you have the rights and consents needed to provide Your Content, including permission from anyone who appears in or is recorded in it.

Content from others. Content posted by other users, hosts and businesses is their responsibility, not ours. We do not review all content and do not endorse it.

Moderation, reports and appeals. We may screen, remove or limit content, and suspend accounts, that break these Terms or the law. Report content in the app or at support@dealchief.ai. If we take action against your content or account, you can appeal by replying to our notice; we will review it and tell you the outcome.

5. Acceptable use

You may not use DealChief to:

  • break any law, including consumer protection, privacy, recording-consent, telemarketing, anti-spam and export laws;
  • record, capture or share a call or webinar without the consent the law requires;
  • harass, threaten, defraud or impersonate anyone, or misrepresent your affiliation;
  • post content that is hateful, sexually explicit, violent or illegal, or any content that sexualizes or exploits minors;
  • send unsolicited invitations or messages, or abuse referral links (including self-referral, fake accounts or misleading promotion);
  • sell illegal goods or services, or run gambling, lotteries or investment schemes through webinars;
  • collect sensitive information (payment card, health, biometric or government ID numbers) through registration forms or chat;
  • upload malware, probe, overload or interfere with our systems, or access them other than through our interfaces;
  • scrape, copy, reverse engineer or resell DealChief, or use it or its Output to build a competing product or train AI models;
  • get around usage limits, safety features or blocks.

6. Webinars: hosts

If you host or co-host a webinar, you are responsible for:

  • its content and delivery, and the accuracy of its title, description, schedule, price and any promises in it;
  • holding the rights to everything you present, play or share;
  • telling attendees when you record, and getting any consent the law requires;
  • using attendee information (including exported lists and registration form answers) only for that webinar and as the law allows. For that information you act as an independent controller, responsible for your own privacy and anti-spam compliance;
  • your own taxes on earnings.

You may set capacity, waitlists, registration forms, private invitations and session bundles. You may remove attendees who break these Terms or your published rules, subject to Section 8.

7. Webinars: registration and payment

  • The host sets the registration fee. You are charged when you register, in the currency shown for the webinar, to the card or PayPal account you use. The price you see is the price you pay: our platform fee is not added on top. Taxes, where they apply, are shown before you pay.
  • Seat hold. We hold your seat for 10 minutes while you pay. If you do not finish paying in that time, the seat is released and you are not charged.
  • Card payments are processed by Authorize.net and PayPal payments by PayPal. MyCommunity Today collects registration fees on the host’s behalf as its limited payment collection agent, so paying us satisfies your obligation to the host. We do not store full card numbers.
  • Refund percentage. Each paid webinar has a refund percentage that applies if you unregister before it starts. The host can set any percentage from 0% to 100%; if the host has not set one, it is 70%. It is shown before you pay, and the percentage shown when you pay stays with your registration even if the host changes it later.
  • You pay once for every date in a recurring series.
  • If a host offers “Register for all”, you pay one discounted price for the sessions in the bundle. That price is divided across the sessions in proportion to each session’s listed price, and each session stays separate. You are not added automatically to sessions the host creates later.
  • Joining a waitlist does not guarantee a seat.
  • Your responsibility. You are responsible for the account and payment method you use to register.
  • App store purchases, if offered, follow that store’s payment and refund terms.

Conduct and recordings. While attending, follow the acceptable use rules in Section 5 and any rules the host publishes. The host, co-hosts or MyCommunity Today may remove anyone who breaks them; refunds on removal follow Section 8. If a webinar is recorded, everyone sees a recording indicator. The host decides who can view the recording, and you may not download, copy, re-record or share it unless the host allows.

8. Cancellations and refunds

Situation You receive Notes
You unregister before the start The refund percentage (default 70%) $100 registration at 70% = $70 back, $30 kept
You unregister after the start, or do not attend Nothing You cannot unregister for a refund after the start time
Host cancels before the start 100% Includes the rest of any partial refund already paid
Host removes you before the start 100% Always a full refund
Host removes you while live 100% or nothing The host chooses
Host removes you after the end Not possible Paid attendees are not removed after the webinar ends
Series: you unregister before the series starts Refund percentage of the series price —
Series: host cancels one date 100% of that date's share Your other dates stay
Series: host cancels the whole series before it starts 100% of the series price —
Bundle: you leave one session Nothing at that time That session's share is refunded later if the host cancels it

If you unregister. You can unregister only before the webinar or session starts, and you receive the refund percentage of what you paid. On a $100 registration at 70%, you receive $70; the remaining $30 is not returned. You are removed from the webinar as soon as you unregister. After the start time you cannot unregister for a refund, and if you do not attend you do not receive a refund.

If the host cancels. Hosts can cancel only before the start time. You receive 100% of what you paid for that webinar or session. If you had already unregistered and received a partial refund, you also receive the rest, so you get 100% in total. On a webinar with more than one session, the host can cancel one session or every session that has not started. A session that has already started stays as scheduled, and the money for it is not refunded.

If the host removes you. Before the start time, removal always includes a full refund. While the webinar is live, the host may remove you with a full refund or without a refund. After the webinar has ended, a paid attendee cannot be removed.

A series of dates. If you unregister before the series starts, you receive the refund percentage of the series price. If the host cancels one date, you receive 100% of that date’s share and stay registered for the others. If the host cancels the whole series before it starts, you receive 100% of the series price. If the host removes you during one live date and chooses to refund, you receive that date’s share and stay registered for the other dates.

A bundle of sessions. If you leave one session yourself, you receive nothing back at that time; if the host later cancels that session or the webinar, you receive that session’s share. If the host removes you before a session starts, you receive that session’s share. If the host cancels every session while all are still in the future, you receive the full bundle price; if one session has already started, you receive the shares of the sessions still upcoming. Example: sessions listed at $40, $40 and $20 with a 20% bundle discount cost $80, divided into $32, $32 and $16. If the host cancels the whole webinar before the first session, you receive $80. If the $20 session has already started and the host cancels the other two, you receive $64.

Free webinars have no payment and no refund.

If a webinar cannot be held. If a webinar or session cannot be held or completed because of a technical failure on our side or an event outside the host’s control, and it is not rescheduled within 30 days, it is treated as cancelled by the host and you receive 100% of that session’s share. If it is rescheduled, your registration moves to the new time. [Proposed wording; confirm.]

How a refund reaches you. Refunds go to the original card or PayPal account and are a percentage of the price you paid; no separate card fee is deducted. Refunds are not instant. If your payment has not settled with the bank yet, the refund is sent after it settles, and your bank may take several business days to show it. If the payment provider cannot complete a refund automatically, you still receive the same amount.

Chargebacks. Please contact support@dealchief.ai before disputing a charge with your bank. A chargeback does not replace these refund rules. If you file one, we will respond with the transaction records and may suspend your registration and account while it is open. If it is decided in your favor, you will not also receive a refund under these Terms. [Proposed wording; confirm.]

Except as stated in this Section or required by law, registration fees are non-refundable.

9. Host fees, earnings and payouts

  • Cancelling and removing. Hosts can cancel a webinar or session only before it starts; a cancel after a session has started or ended is refused. Hosts can remove attendees only as described in Section 8.
  • Platform fee. Our platform fee is 2% of each registration fee. It is deducted from the host’s earnings, not added to the attendee’s price.
  • Your earnings. For each paid registration you receive the registration fee, minus any refund, minus the 2% platform fee, minus any referral commission (Section 10). Example: if an attendee unregisters from a $100 webinar with a 70% refund percentage, you receive $28 ($100, minus the $70 refund, minus the $2 fee). If the attendee receives a full refund, you receive nothing. [Confirm the host payout before publishing.]
  • When you are paid. Earnings are held until 7 days after the webinar or session ends, and can then be claimed from the Earnings dashboard. The payout screen shows the breakdown before you confirm.
  • Payout details. To receive payouts you must provide accurate payout details (bank account or PayPal) and tax information, and pass any identity checks we require. We may report earnings to tax authorities and issue tax forms as the law requires.
  • Holds and offsets. We may hold or offset payouts to cover refunds, chargebacks, disputes or suspected fraud, and recover negative balances from future payouts. Funds held for you do not earn interest.

10. Referral Program

Who can refer. Attendees with a paid, admitted registration and co-hosts get a personal referral link for that webinar. Hosts cannot earn referral commission on their own webinars.

What you earn. For a paid webinar, a percentage of the registration fee set by the host. For a free webinar, a reward amount set and funded by the host. The rate that applies is the one in effect when your friend registers; later changes do not affect it. There is no cap on the number of referrals. Referral commission comes out of the host’s share, not the attendee’s price.

When a referral counts. You are paid only if all of these are true when the webinar or session ends:

  • your friend registered through your link and paid any fee;
  • your friend is still registered (attendance is not required);
  • you are still registered;
  • the webinar was not cancelled, and your friend’s fee was not fully refunded.

If the host had already invited your friend directly, the host’s invitation takes priority and the referral earns nothing. If you unregister, you forfeit all referral commission from that webinar.

Claiming. If your friend unregisters, is removed or the webinar is cancelled, you earn nothing on that registration. Commission is held until 7 days after the webinar or session ends, then becomes claimable. Claim it from your dashboard after giving payout and tax details, as in Section 9.

Fair play. You may not refer yourself, use multiple or fake accounts, spam your link, or describe a webinar in a misleading way. We may withhold or reverse commission earned through fraud or a breach of these Terms. Rewards are not transferable and have no cash value until paid. Referring does not make you our employee, agent or partner. We may change or end the program with notice; commission already claimable when it ends will be paid.

11. Fees and taxes

Downloading and using DealChief’s core features is free. Paid features show their price before you buy. You are responsible for any taxes that apply to your purchases or earnings, other than taxes on our income. We will give at least 30 days’ notice before increasing the price of any recurring subscription.

12. Communications

You agree to receive account, transaction and service messages from us electronically by email, in-app notification, push notification or SMS. If you give us your phone number, you agree to receive sign-in codes and webinar reminders by SMS; message and data rates may apply, and you can reply STOP to opt out of non-essential texts. Marketing messages are optional and you can unsubscribe at any time.

13. Our property and feedback

DealChief, including its software, avatars, designs and the DealChief and MyCommunity Today names and logos, belongs to MyCommunity Today and its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for its intended purpose under these Terms. We may update the app automatically. If you give us feedback or suggestions, we may use them without obligation to you.

14. Third-party services

DealChief relies on services from others, including Amazon Web Services, Authorize.net, Google and PayPal, and may link to third-party sites. Their availability and practices are outside our control, and your use of them is governed by their terms.

15. Copyright complaints

If you believe content on DealChief infringes your copyright, send a notice to our designated agent at [DMCA agent name and address] or support@dealchief.ai with: your signature; identification of the work; identification and location of the infringing material; your contact details; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and you are authorized to act. We will terminate the accounts of repeat infringers where appropriate.

16. Suspension and termination

You can stop using DealChief and delete your account at any time in the app (Settings → Account → Delete Account) or at https://dealchief.ai/delete-account. We may suspend or end your access if you break these Terms, if required by law, or to prevent harm, and may close free accounts inactive for more than 2 years after notice. If we end your account without cause, we will pay out any claimable earnings and refund prepaid, unused fees. If we end it for a breach, we may withhold amounts connected to the breach. Sections 3 to 5, 8 to 10 (for amounts already owed), and 13 to 23 survive.

17. Disclaimers

DEALCHIEF IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT DEALCHIEF OR ANY OUTPUT WILL BE UNINTERRUPTED, ACCURATE OR ERROR-FREE. WE ARE NOT A PARTY TO, AND ARE NOT RESPONSIBLE FOR, THE CONTENT OR QUALITY OF WEBINARS, OR DEALINGS BETWEEN HOSTS AND ATTENDEES OR BETWEEN BUSINESSES AND THEIR CUSTOMERS, EXCEPT FOR OUR PAYMENT AND REFUND OBLIGATIONS IN THESE TERMS.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, EVEN IF WE WERE ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO DEALCHIEF IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR US$100. Some jurisdictions do not allow these limits, so they may not fully apply to you.

19. Indemnity

If you host webinars, run a business’s AI agent, or use DealChief for an organization, you will defend, indemnify and hold harmless MyCommunity Today and its officers, employees and agents against third-party claims, losses and costs (including reasonable legal fees) arising from Your Content, your webinars, statements your agent makes at your direction, your use of attendee data, or your breach of these Terms or the law.

20. Dispute resolution and arbitration

Informal resolution first. Before starting a claim, you and we each agree to send a written description of the dispute (to support@dealchief.ai for you) and try to resolve it informally for 60 days. Limitation periods are paused during that time.

Binding individual arbitration. Any dispute relating to these Terms or DealChief that is not resolved informally will be decided by binding individual arbitration administered by National Arbitration and Mediation (NAM) under its consumer rules, governed by the Federal Arbitration Act. Hearings will be by videoconference where possible. Each side pays its own legal fees, except as the rules or law provide.

Exceptions. Either side may bring an individual claim in small claims court, and either side may ask a court for an injunction to stop infringement or misuse of intellectual property or unauthorized access to DealChief.

No class actions or jury trials. Claims may be brought only individually, not as a plaintiff or class member in any class, consolidated or representative action. You and we waive any right to a jury trial. Requests for public injunctive relief will be decided by a court after arbitration of the individual claims.

Mass filings. If 25 or more similar claims are filed by the same or coordinated counsel within 90 days, they will be administered in batches of up to 50 claims.

Opt out. You may opt out of this Section by emailing support@dealchief.ai from your account email, with the subject “Arbitration opt-out”, within 30 days of creating your account (or of a change to this Section taking effect).

Severability. If the class action waiver is found unenforceable for a claim, that claim proceeds in court and this Section does not apply to it.

21. Governing law and courts

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Claims not subject to arbitration will be brought exclusively in the state or federal courts located in [county, state of our principal office], and both parties consent to their jurisdiction.

22. App Store and Google Play terms

If you downloaded DealChief from Apple’s App Store:

  • These Terms are between you and MyCommunity Today only, not Apple. Apple is not responsible for the app or its content.
  • Your license is limited to using the app on Apple-branded devices you own or control, as allowed by the App Store Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • MyCommunity Today, not Apple, is responsible for any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • If a third party claims the app infringes its intellectual property, MyCommunity Today, not Apple, is responsible for investigating, defending, settling and discharging the claim.
  • You confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded DealChief from Google Play, Google’s terms for Google Play also apply to your download, and Google is not responsible for the app.

23. General

  • Changes to these Terms. We will post updates here. For changes that materially reduce your rights, we will notify you in the app or by email at least 30 days before they take effect. If you keep using DealChief after that, you accept them; if you do not agree, stop using DealChief and delete your account.
  • Export controls. You may not use DealChief in violation of U.S. export controls or sanctions.
  • You may not transfer these Terms without our consent. We may assign them to an affiliate or in a merger, acquisition or sale of assets.
  • Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Entire agreement. These Terms, the Privacy Policy and any feature-specific terms you accept are the whole agreement between us about DealChief.
  • Severability and waiver. If a provision is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver.
  • No other beneficiaries. Except as stated in Section 22, no one else has rights under these Terms.
